BIZ Agency Policies

BIZ AGENCY POLICIES AND PROCEDURES

BIZ Global Media Inc., (BIZ) MARKETING PROGRAM is an equal-opportunity direct sales marketing company and honors all rules and regulations governing direct sales enterprises and private sector business organizations, as defined by federal, state and local authorities.

These Policies and Procedures are an integral part of the BIZ Agency Owners Agreement between BIZ and each BIZ Agency Owners. They have been established to protect the rights of all BIZ Agency Owners and to provide a framework within which BIZ and its BIZ Agency Owners may work on an ethical and effective basis. These Policies and Procedures should be read in their entirety and in conjunction with the Marketing Plan and the Terms and Conditions set forth on the reverse side of the BIZ Agency Owners Application and Agreement Form.

Administrative

1. BIZ Agency Owners Definition: A BIZ Agency Owners is one who has executed a BIZ Agency Owners Application and Agreement application and Agreement Form, which has been accepted and approved by BIZ. BIZ reserves the exclusive right to accept or reject anyone as a BIZ Agency Owners. If an application is rejected by BIZ, notification of such rejection will be given within thirty (30) days from the date the BIZ Agency Owners Application and Agreement Form was received at the BIZ Corporate Office.

An BIZ Agency Owners may have only one Agency Owners sponsor. A partnership or corporation may be an BIZ Agency Owners; however, no individual may participate in more than one (1) BIZ Agency Owners sales organization. A BIZ Agency Owners may Agency Owners sponsor his/her spouse to operate as an independent business.

Corporations, partnerships, and/or trusts may be BIZ Agency Owners ONLY when the BIZ Agency Owners Application and Agreement Form is accompanied by copies of the articles of incorporation, partnership agreements or trust documents. Corporations must provide a complete list of all directors, officers and shareholders of the corporation (a list of shareholders is not required from a corporation with more than 25 shareholders). Partnerships must provide a list of all general and limited partners. Trusts must disclose all trustees and beneficiaries. No application will be accepted for processing without the name of an individual authorized to enter into agreement on behalf of the corporation, partnership, or trust.

Married couples may become BIZ Agency Owners either as joint applicants with the same business interest or as individual applicants with separate business interests. If spouses elect to be separate, they must be personally Agency Owners sponsored by each other and placed in the same group or sales organization.

If a husband and wife, joint applicant BIZ Agency Ownerss, divorce they must notify the company in writing, signed by both parties, indicating how the BIZ Agency Owners position is to be owned thereafter. In the absence of a written agreement signed by both parties, BIZ or a court of competent jurisdiction shall decide the ownership.

2. BIZ Agency Owners Minimum Age Requirement: The minimum age for acceptance as a BIZ Agency Owners is the age of consent in the state where the applicant resides (usually 18 years of age).

3. Expenses, Licensing and Contractual Obligations: All BIZ Agency Owners are independent contractors and are responsible for any expenses resulting from operating their independent business. These expenses include, but are not limited to, licenses required to operate a business, legal costs, fees connected with the use of a fictitious business name, telephone expenses (BIZ does not accept collect calls), advertising, etc. No BIZ Agency Owners shall involve BIZ in any contractual relationships relative to his/her business.

BIZ Agency Owners are independent marketing representatives of BIZ, and are not to be considered purchasers of a franchise or Agency Ownership. The Agreement between the company and its BIZ Agency Owners does not create an employer/employee relationship, BIZ, partnership or joint venture between the company and the BIZ Agency Owners. The BIZ Agency Owners have no authority to bind the company to any obligation. Each BIZ Agency Owners shall hold harmless BIZ from any claims, damages, or liabilities arising out of the BIZ Agency Owners business practices.

4. Territories: There are no exclusive territory assignments. All BIZ Agency Owners have the right to function anywhere within the areas of operation prescribed by BIZ. Any attempt to market BIZ Products and Services or Agency Owners sponsor BIZ Agency Owners in areas outside BIZ prescribed areas of operation will result in immediate termination.

If BIZ Agency Owners relocates to an area outside BIZ prescribed areas of operation, he/she may continue to market the program, but only in those states within the prescribed areas of operation. He/she may not retail products or Agency Owners sponsor new BIZ Agency Owners in the new area of residence until BIZ declares that area to be open for business.

5. Ethics: BIZ recognizes its good reputation and public image to be a major asset for the Agency Owners sponsoring and sales efforts of its BIZ Agency Owners and will guard against unacceptable behavior by those BIZ Agency Owners who step beyond the boundaries of good business ethics. BIZ will intercede to correct unethical activity on the part of any BIZ Agency Owners regardless of rank. Verified unethical activities will be justifiable cause for termination.

6. Identification Numbers: BIZ will generate an I.D. number to cross-reference your other tax ID numbers once the Agency Owners status has been obtained. The Social Security Number or Federal Tax Identification Number of the applicant must also be on record with BIZ and referenced with your assigned ID number.

7. No Initial Product Purchase Requirement: No product purchase is required to be a BIZ Agency Owner. Any and all purchases are made at the sole discretion of the BIZ Agency Owners. However, the compensation and bonuses paid to BIZ Agency Owners may vary upon the BIZ products purchased by BIZ Agency Owners.

BIZ Agency Owners should make clear in each business presentation that absolutely no inventory purchase is required to market BIZ. It should be stressed that BIZ Agency Owners can build their business selling BIZ products on a commission-only basis.

The one and only objective of the BIZ Marketing Program is to promote the use of BIZ products/services to satisfied customers. The sale of wholesale products is not the goal-but rather usage of products by the end-user consumer. This program is not about moving money, it is about acquiring retail customers.

8. BIZ Agency Owners Annual Renewal: Your BIZ Agency Owners Agreement expires annually on the last day of the month in which you became an BIZ Agency Owners. Notification of the renewal date will be sent at least ninety (90) days prior to the expiration date. BIZ Agency Owners must apply to renew and submit payment for the Annual Renewal Fee in the amount of $25.

Failure to renew annually results in the loss of all BIZ Agency Owners rights, removal from the marketing structure, forfeiture of future bonuses, and loss of sales organization. BIZ Agency Owners who terminate based on non-renewal may reapply within sixty (60) days, but must begin at the entry level without their previous advertising customers and sales organization. BIZ will diligently attempt to notify each BIZ Agency Owners prior to his/her renewal date; however, the ultimate responsibility for timely annual renewal rests with the BIZ Agency Owners.

9. The BIZ Agency Owners Commitment: In order to properly promote BIZ products, services and the BIZ Marketing Plan, as well as to achieve the maximum potential for success, an BIZ Agency Owners agrees to: Become well acquainted with the BIZ sales materials, including the company’s Marketing Plan and Policies and Procedures.

Attend sales training provided by the company or selected trainers approved by the company.

Sell products/services at retail in accordance with the BIZ Marketing Plan.

Know and comply with applicable state and local tax requirements, as well as laws concerning consumer rights, sales taxes and any ordinances affecting the sale of BIZ products/services.

Make no claims or guarantees concerning products or profits other than those contained in company literature or make any changes in the information submitted on their BIZ Agency Owners Agreement.

Take responsibility for the training and education of those Agency Owners in their immediate sales organizations, whether personally Agency Owners sponsored or not.

Wear appropriate business attire (as well as guests) when attending business presentations to further enhance the company’s professional public image.

Ensure that all paperwork submitted to the company is complete and accurate in accordance with the processing instructions then in effect and that such paperwork is accompanied by full and complete payment in the form(s) deemed acceptable by the company. This also includes applicable documentation relating to DBA's (Business Entity - Doing Business As).

10. Obligations of the Company: Under the terms and conditions of BIZ Marketing Plan and these Policies and Procedures, BIZ agrees to:

Make available quality products/services to the BIZ Agency Owners for the purpose of both retail sales and consumption.

Make available quality support materials to aid in the retail sales of products/services and Agency Owners sponsoring of other BIZ Agency Owners.

Make compensation payments to BIZ Agency Owners on orders received within a business week/calendar month in accordance with BIZ Marketing Plan then in existence. Bonuses shall be paid on all orders received at the BIZ Corporate Office by the close of business on the last day of a business week/calendar month, provided said orders are accompanied by the correct amount and approved form of payment.

11. Amendments: From time to time, economic or legal conditions may dictate revisions in wholesale/retail pricing, Policies and Procedures, and BIZ Marketing Plan. BIZ expressly reserves the right to make any such amendments at any time it deems necessary by giving BIZ Agency Owners written notice and such amendments shall automatically become part of the BIZ Agency Owners Agreement between BIZ and its BIZ Agency Owners.

12. Transfer/Assignment of Business: An BIZ Agency Owners may not sell, assign or otherwise transfer his/her rights or position without the written approval of the company. The BIZ Agency Owners position must be offered in writing, first to the seller’s Agency Owners sponsor, then to the Agency Owners sponsor’s Agency Owners sponsor, up to a maximum of three (3) levels. If the three (3) up line Agency Owners sponsors decline the offer, the BIZ Agency Owners may offer the position for sale to anyone who does not already participate in an BIZ Agency Owners position. In other words, if the three (3) up line Agency Owners sponsors decline the offer, then the position may be sold to someone outside BIZ Marketing Program. The offer must be on the same terms and conditions as to the three (3) up line Agency Owners sponsors. The company reserves the right to approve the transaction. An BIZ Agency Owners who sells his/her BIZ Agency Owners position shall not be eligible to re-qualify as an BIZ Agency Owners for a period of at least sixty (60) days after the company has approved the sale in writing.

13. Inheritance: Upon the death or incapacity of the BIZ Agency Owners, the BIZ Agency Owners position and all rights will pass to the legal successor. BIZ requires photocopies of the Death Certificate (or a doctor’s statement) and a certified Will, court order or other appropriate legal documentation before the transfer will be effective.

14. Agency Owners sponsorship Transfers: BIZ prohibits transferring from one Agency Owners sponsor to another without written authorization and confirmation form old and new Agency Owners sponsor.

15. Agency Owners sponsoring Rights: All BIZ Agency Owners of BIZ have the right to refer Agency Owners sponsor. Occasionally, one or more people may contact the same prospect and questions may arise as to who has Agency Owners sponsoring rights for that prospect. BIZ will not mediate such disputes and will recognize as the Agency Owners sponsor the individual whose name appears on the original BIZ Agency Owners Application and Agreement Form.

16. Agency Owners sponsor’s Responsibilities: All new BIZ Agency Owners have the right to receive free training and support from their Agency Owners sponsor. A Agency Owners sponsor is expected to provide information on how to obtain company-approved literature and to give Fast Track Training to their newly Agency Owners sponsored BIZ Agency Owners.

Any BIZ Agency Owners who Agency Owners sponsors other BIZ Agency Owners must fulfill the obligation of performing a bona fide supervisory, presentation and selling function in the sale of products/services to the end-user consumer and in the training of those Agency Owners sponsored representatives. An BIZ Agency Owners must have ongoing contact, communication and management supervision with his/her sales organization. Examples of such supervision may include, but are not limited to: newsletters, written correspondence, personal meetings, telephone contact, voice mail, electronic mail, training sessions, accompanying individuals to company training, and sharing genealogy information with those Agency Owners sponsored. BIZ Agency Owners should be able to provide evidence to the company quarterly regarding fulfillment of these responsibilities.

17. Conduct At Business Presentations and Fast Track Training Sessions: All Business Presentations and Fast Track Training sessions shall be conducted in strict conformity with company produced scripts, slides, CD ROM’s and printed materials. These materials may not be altered or deviated from in any way. They have been developed and refined to ensure that prospects have accurate information upon which to base their decision and to assist new BIZ Agency Owners in learning proven techniques for achieving success within prescribed guidelines. For this reason, any substantive alteration of scripts, slides, printed materials or videos, or any deviation in the prescribed presentation thereof which compromises the integrity and/or intent of the BIZ program, will result in termination of the offending BIZ Agency Owners(s).

18. Product Liability Insurance: BIZ extends no warranties, expressed or implied; beyond those specifically articulated by the advertiser or manufacturer of the products/services offered through BIZ advertising. BIZ offers no guarantees beyond the manufacturers standard provision.

19. Claims: BIZ Agency Owners of BIZ shall not make any claim regarding the products/services or the Marketing Plan, which has not been expressed in official BIZ literature. BIZ is responsible only for material printed in company-approved literature (audio/video).

BIZ Agency Owners are expressly forbidden to imply that additional products or services will be added or those enhancements to the Marketing Plan are forthcoming.

20. Regulatory Approval: No governmental body, whether it be a State Attorney Generals Office, a Secretary of States Office, a Consumer Protection BIZ or a State or Federal Trade Commission approves or endorses any marketing program.

BIZ markets its program only in states where it has established/will establish communication with regulatory agencies. Although BIZ prides itself on efforts to assure good relations with all the states within its areas of operation, no BIZ Agency Owners may ever imply that the promotion, operation or organization of BIZ has been approved, sanctioned or endorsed by any regulatory authority. Such statement or implication constitutes grounds for termination as an BIZ Agency Owners.

21. Dispute - In the event a dispute shall arise between BIZ and BIZ Agency Owners, Master Advisor and Master Agency Owners as to their respective rights, duties and obligations under the Agreement, such dispute shall be submitted to arbitration under the rules of the American Arbitration Association. The arbitration shall be held at Santa Ana, California. The decision of the arbitrator shall be final and shall be entitled to enforcement in any court of competent jurisdiction.

22. Voluntary Termination: BIZ Agency Owners of BIZ choosing to terminate their association with BIZ/BIZ, must do so by submitting a signed and notarized letter of resignation to BIZ Corporate Office and a copy to their Agency Owners sponsor. The terminating BIZ Agency Owners will be eligible to reapply again after a three (3) month period, but must begin at the entry level and create a new sales organization. Any involvement in the marketing of BIZ after an BIZ Agency Owners has resigned and before he/she has reapplied after the three (3) months, will be cause for denying them re-entry into the program.

23. By becoming a BIZ AO, you agree to receive daily emails with updates about the company. Your email is safely secure, and is not given out without express permission from you.

24. The BIZ marketing system is designed to be used as an advertising tool for any business type and size to advertise market and sell their products and services. The BIZ are NOT for resale the company does not encourage, support or allow direct retailing of the calling cards as a standalone phone calling card.

Involuntary Termination: When a violation of the BIZ Agency Owners Agreement or these Policies and Procedures is verified by BIZ, the Company may elect to terminate the offending BIZ Agency Owners. Such violations include, but are not limited to:

Failure by the BIZ Agency Owners to renew by the annual expiration date of his/her BIZ Agency Owners Agreement. Violations of the BIZ Agency Owners Agreement and/or the Policies and Procedures by the BIZ Agency Owners. An BIZ Agency Owners making unauthorized claims, misrepresentations, or who discredits BIZ, its products, services or programs.

BIZ Agency Owners are strictly prohibited from contacting the various BIZ product/service providers for information about the BIZ program. All pertinent information is contained in BIZ sales literature. If an BIZ Agency Owners has a specific question not covered in company literature, he/she should contact his/her Agency Owners sponsor, then the representative Services Department at BIZ Corporate Office. Policies and Procedures which also detail conduct which may lead to termination as an BIZ Agency Owners are as follows:

1. Administrative Section, paragraph 4, regarding attempts to market outside the States in BIZ areas of operation.

2. Administrative Section, paragraph 5, regarding unethical behavior.

3. Administrative Section, paragraph 19, regarding statements or promises beyond those which are expressed in official BIZ materials regarding product/service benefits or the Marketing Plan.

4. Administrative Section, paragraph 22, regarding marketing BIZ after resigning and before the three (3) month waiting period has expired. This will prevent that person from ever being readmitted to BIZ.

5. Administrative Section, paragraph 33, regarding confidentiality and nondisclosure of genealogical information.

6. Advertising and Promotion Section, paragraph 1, regarding use of authorized promotional materials.

7. Advertising and Promotion Section, paragraph 2, regarding blind advertising which prohibits reference of any type to the names of any corporate executives, officers, employees, product/service providers, endorsement personalities or financial institutions through which the BIZ program may be administered.

8. Advertising and Promotion Section, paragraph 3, regarding claims beyond those expressed in company-produced materials.

9. Advertising and Promotion Section, paragraph 4, regarding exaggerated income claims.

10. Advertising and Promotion Section, paragraph 5, regarding prohibited inducements to prospects.

11. Advertising and Promotion Section, paragraph 6, regarding the sale of other goods or services during the conduct of one’s BIZ business or at BIZ presentations.

12. Advertising and Promotion Section, paragraph 12, regarding production of copyrighted materials.

13. Advertising and Promotion Section, paragraph 13, regarding telephone directory listings.

14. Advertising and Promotion Section, paragraph 14, regarding proper method of answering the telephone.

15. Advertising and Promotion Section, paragraph 15, regarding the use of automatic calling devices.

16. Advertising and Promotion Section, paragraph 16, regarding radio or television talk-show appearances and media requests for interviews.

17. Advertising and Promotion Section, paragraph 8, regarding the use of BIZ within a business name.

18. Violations that jeopardize BIZ position with any regulatory body or with any product/service provider must be dealt with swiftly. Offenders will be summarily terminated. Otherwise, when BIZ verifies a violation, the following termination procedures shall apply:

The company will send an official notice of intent to suspend/terminate said BIZ Agency Owners.

The offending BIZ Agency Owners will have ten (10) business days in which to present his/her case for review by the company.

BIZ will then make the final decision as to suspend/terminate the BIZ Agency Owners.

19. BIZ Agency Owners Refunds/Inventory Returns: Prior to returning any BIZ sales aids/literature, an BIZ Agency Owners must obtain a Return Merchandise Authorization Number and Label from BIZ. To acquire this RMA number, you must submit written documentation and call BIZ representative Services Department. A Return Authorization number will be assigned to the BIZ Agency Owners and products or sales aids/literature items must be shipped to BIZ Corporate Office, freight paid, by the BIZ Agency Owners with the label affixed to the outside of the package. All returns must be in their original, resalable condition. There is a 20% re-stocking fee for any order cancellation and refund for any card orders and marketing materials.

20. Sales Tax: Just as in any other business, operating your BIZ business as an BIZ Agency Owners will also involve sales taxes. Requirements for sales taxes vary among states, cities and counties.

21. BIZ will collect sales taxes on all sales of Sales Aids/literature items from BIZ Agency Owners within the State of California.

22. Income Tax: BIZ Agency Owners are independent contractors for federal and state income tax purposes and do not have income taxes withheld from commissions. BIZ Agency Owners are responsible for sorting and paying income taxes to local, state and federal authorities. BIZ will provide an IRS Form 1099 to the IRS and BIZ Agency Owners annually in accordance with federal laws. A copy of such form may be obtained and printed from the BIZ/BIZ Agency Owners Control Center.

Please keep in mind there are many tax benefits available to independent contractors under the provisions of the existing tax laws. BIZ Agency Owners are responsible for contacting proper taxing authorities or an accountant for up-to-date information on tax laws.

23. Self-Employment Tax: BIZ Agency Owners must individually pay self-employment taxes unless an adequate amount of Social Security tax is being paid as a result of other employment. Forms and instructions may be obtained from the local IRS office.

24. Unemployment Tax: BIZ makes no contributions to any of the various state employment funds, because of the BIZ Agency Owners independent contractor status. Since payments are not made, a BIZ Agency Owners is not eligible to claim unemployment compensation as a result of having been associated with BIZ as an BIZ Agency Owners.

25. Compliance: A BIZ applicant will not be eligible for commissions and bonus awards, nor will an applicant be allowed to Agency Owners sponsor in the BIZ Marketing Plan until a signed BIZ Agency Owners Agreement has been received and approved by BIZ Corporate Office. The signature on that Agreement indicates the applicant’s approval and acceptance of the rules and regulations of the company.

26. The BIZ program is built upon sales of products/services to the end-user consumer. The company recognizes that its BIZ Agency Owners may wish to also purchase products/services for personal and family use and grants commission credit in the Marketing Plan for such purchases. However, the company expressly prohibits purchases of products/services solely for qualification within the Marketing Plan.

27. BIZ Agency Owners are expected to perform bona fide supervisory functions in the marketing of products/services to the end-user consumer. BIZ Agency Owners are expected to supervise, train and have ongoing contact and communication with their sales organizations.

28. BIZ reserves the exclusive right to terminate any BIZ Agency Owners who violates any provision of the BIZ Agency Owners Agreement, the Policies and Procedures and any amendments thereto. Such termination cancels any and all rights and will be effective upon the verification by BIZ of said violation(s) and notification to the offending BIZ Agency Owners.

29. Cross-Agency Owners sponsoring: A BIZ Agency Owners may Agency Owners sponsor into any other marketing/multilevel organization only those BIZ Agency Owners he/she has personally Agency Owners sponsored. An BIZ Agency Owners shall not offer the opportunities nor products and services of any other marketing/multilevel marketing company to other BIZ Agency Owners, other than those he/she has personally Agency Owners sponsored.

30. Change of Status: An BIZ Agency Owners may change status from individual to partnership or corporation or from partnership to corporation, by notifying BIZ in writing providing details of all participants in the new entity and all related supporting documentation.

31. Outstanding Collections: The Company has the right to offset any monies owed in arrears by the BIZ Agency Owners either in his/her capacity as an BIZ Agency Owners or consumer against bonuses and commissions earned as a result of product/service sales.

32. Confidentiality and Nondisclosure: On a periodic basis, the company will supply data processing information to the BIZ Agency Owners concerning the BIZ Agency Owner’s sales organization. The BIZ Agency Owners agrees that such information is proprietary and confidential to the company and is transmitted to the BIZ Agency Owners in confidence. The BIZ Agency Owners agrees that he/she will not disclose such information to any third party directly or indirectly, or use the information to compete with the company directly or indirectly. The BIZ Agency Owners and the company agree, without this agreement of confidentiality and nondisclosure, the company would not provide the above confidential information to the BIZ Agency Owners. Violation of this confidentiality requirement is grounds for termination.

33. Partial Invalidity: Should any portion of these Policies and Procedures of the BIZ Agency Owners Application and Agreement, or of any other instruments referred to herein or issued by the company be declared invalid by a court of competent jurisdiction, the balance of such Policies and Procedures, Applications, or instruments shall remain in full force and effect.

ACCOUNTING

1. Bonus Computation Periods. The BIZ commission compensation/pay is paid periodically on a daily and monthly basis. All BIZ Agency Owners product/service sales, having been paid in full, online payment processing, check, cashier’s check, money order, cash or credit cards. All mailed payment must be received by BIZ corporate offices before any commission computations. Commissions will be paid to the BIZ Agency Owners no later than the following calendar month for all personal bonuses, commissions and overrides. Any commission error's generated by the BIZ computerized systems must be communicated and addressed in writing to BIZ administrative and support staff no later than 60 days after date of product purchase.

2. Consecutive Calendar Months. All promotional sales volume activity is calculated from the first day of the calendar month through the last day of a calendar month.

4. Bonus/Commission Issues. Any questions or disputes about bonus/commission calculations or checks must be raised with the representative Services Department within one calendar month after the payment date. All disputes must be submitted in writing. It is the responsibility of the BIZ Agency Owners to supply all essential supporting documentation.

5. Accounting Fee. A computer processing/accounting fee of $3 will be deducted automatically from bonus/commission checks.

6. One Order/One Form of Payment. When BIZ Agency Owners are submitting orders for products/services or Sales Aids/literature items, a single form of payment must accompany these items. Said form of payment must be in a form acceptable to the company; namely, a personal or business check, cashier’s check, money order or acceptable charge cards, and be for the exact amount of the order. BIZ Agency Owners may not combine orders together and must submit a single form of payment to cover all orders.  Isolated violations of this rule are not significant; however, repeated violations of this rule may lead to disciplinary action or suspension/termination.

7. Personal Checks. When personal checks are submitted to BIZ for payment of any transaction, any associated Business or Personal Sales Volume will be withheld pending approval by our check verification service.

8. Charge Backs. In the event of returns or checks returned for insufficient funds or stop payments, any commissions that have been paid to the BIZ Agency Owners will be charged back.

9. Seventy Percent Rule. The BIZ program is built upon retail sales of products/services to the end-user consumer. It is company policy to strictly prohibit the purchase of products/services solely for the purpose of qualifying for commissions or bonuses. BIZ Agency Owners must not purchase any advertising inventory load nor encourage others to do so. To this end, when purchasing products from BIZ, a BIZ Agency Owners is required to certify that at least 70% of all previous orders have been sold at retail. Violation of the 70% rule will cause forfeiture of a any commission or bonuses for those otherwise qualified or in such cases, suspension or termination.

10. Change of Address Notification. A BIZ Agency Owners requiring a change in his/her record (address, telephone number, etc.) must send a signed letter to BIZ representative Services Department requesting the change.

ADVERTISING AND PROMOTION

In order to maintain the integrity and accuracy of the BIZ image, stringent requirements and guidelines governing advertising and promotion by BIZ Agency Owners must be imposed. Misuse of the BIZ name or logo and its Agency Owners products and/or services diminishes the goodwill of the company and affects all BIZ Agency Owners. No BIZ Agency Owners is permitted to advertise in any medium, other than personal contact or personal phone calls, until he/she has completed the Fast Track Training Program. Agency Owners sponsors must ensure that each BIZ Agency Owners has sufficient training and will not knowingly violate these Policies and Procedures. For this reason, misuse may lead to the termination of an BIZ Agency Owners.

1. Use of Authorized Promotional Materials: Only those materials, which have been made available directly by the company, are allowed for promotional purposes. The company will produce and offer for sale at a reasonable price the materials necessary to build an BIZ Agency Owners business. No reproduction, personalization or modification of any of these company materials is allowed in any form. BIZ Agency Owners may not develop, publish, sell or distribute any promotional materials they create. This prohibition applies also to Sales Aids and brochures promoting a specific downline or organization. (See paragraph 5 below regarding prohibited inducements.) Any violation of this rule may lead to termination of a BIZ Agency Owners.

2. Blind Ads: As independent contractors, BIZ Agency Owners are free to promote their business in any legal manner and may advertise without company approval, provided they do not use the BIZ trade name, trademarks or logo, or make unauthorized claims or references of any type to the name of the corporate executives, officers, employees, product/service providers, endorsement personalities, financial institutions through which the program may be administered, or the name of any group or individual who is associated with BIZ.

No radio or television advertising of any type is permitted. All print ads must include the BIZ Agency Owners name and the last four digits of the BIZ Agency Owner’s BIZ Identification Number. For example, a print ad could end with the statement, for details, call Joe Jones #7777 at (714) 555-5555, but it could not say for details, call John Jones, BIZ Agency Owners of BIZ at (714) 555-5555. The latter statement is prohibited because it uses BIZ name, which makes the ad no longer blind. Also, it does not contain the representatives Identification Number, which BIZ will use for control purposes.

3. Product Claims: BIZ Agency Owners shall not resent any claim for any product or service, which is not, expressed in official BIZ promotional materials. BIZ is responsible only for material printed or contained in company-provided promotional materials.

4. Income representations: BIZ Agency Owners of BIZ shall not make any false or misleading statements about their own or any other BIZ Agency Owner’s income. No hypothetical examples of what is mathematically possible, nor income representations, projections or potentials may be used in any Business Presentation. Stating your own actual income or, with written permission, the actual BIZ income of another BIZ Agency Owners, is permitted. Exaggeration of your own or another BIZ Agency Owner’s actual income will be grounds for termination. No BIZ Agency Owners of BIZ can guarantee THE SUCCESS OF ANY PROSPECT. BIZ Agency Owners shall avoid any suggestion that it is easy to attain high income levels, and shall always explain that each individual’s success depends solely upon the level of effort expended and their personal commitment to the BIZ program.

5. Inducements to Prospects: BIZ Agency Owners of BIZ shall not make any promises about providing prospects or actually placing new BIZ Agency Owners under a prospect as an inducement to Agency Owners sponsorship. Ultimately, each BIZ Agency Owners is responsible for building his/her own organization. It is grounds for termination to promise or imply that one BIZ Agency Owners will build an organization for another as an inducement to Agency Owners sponsorship through advertising support of any means other than training and supervisory assistance.

All BIZ Agency Owners of BIZ are equal in the eyes of BIZ Corporate Office Management. No organization may imply that it has a special relationship or that it can offer a prospect preferred treatment by virtue of this special relationship with the BIZ Corporate Office.

6. Business Cards/Stationery: BIZ provides business cards and stationery through an approved outside vendors list. It is permissible for an Agency Owners to use the services of a printer of their choice, providing that BIZ guidelines are followed. For this purpose, the BIZ logo may be duplicated on the business card or stationery, but the words Agency Owners must appear immediately beneath the logo. This format does not allow the use of a sales organizations name or logo. All that may be printed on the card is a (a) phone number(s), (b) two lines of address, (c) name, (d) BIZ Agency Owners title (Advisor, Agency Owner, Areas Agency Owner, Regional Agency Owner, National Agency Owner and International Agency Owner), (e) web address and (f) e-mail address.

7. Business Names: No BIZ Agency Owners may use the words, BIZ or BIZ Inc., within a business name. BIZ of Los Angeles or Smith BIZ are examples of unauthorized use of the trademarked BIZ Corporation name.

8. Alien Materials or Products: During the term of the BIZ Agency Owners Agreement, BIZ Agency Owners shall not sell or promote directly or indirectly the products, services or opportunities of any other company while conducting their BIZ Business. Additionally, only BIZ products and/or authorized promotional materials may be sold or displayed at any BIZ meeting. Violation of this provision is justifiable cause for termination as a BIZ Agency Owners.

9. Copyrights: BIZ reserves the ownership rights to contents of all company-published materials and all company-Agency Owners sponsored training sessions. Any use or reproduction by any means requires prior written approval from the BIZ Corporate Office.

10. Telephone Advertising: Advertising in a telephone directory is a valuable method of attracting new customers and recruiting new BIZ Agency Owners. BIZ Agency Owners should check with their local telephone company advertising representative to find out the different types of listings available in their area(s). An example of a company-approved listing is:

Agency Owner’s Telephone Number

No BIZ Agency Owners may contract for a display-type ad in any telephone directory. BIZ Agency Owners may not list their telephone number with the telephone company as BIZ or in any way cause the local directory assistance operators to refer callers searching for the BIZ Corporate Office or any satellite office thereof to their number. In the event a BIZ Agency Owner receives a call meant for the BIZ Corporate Office, it is incumbent upon those BIZ Agency Owners to refer the caller to the Corporate Office.

BIZ Agency Owners terminating their BIZ Agency Owners Agreement with BIZ who have a business telephone directory listing as BIZ Agency Owners should have that listing cancelled immediately upon their termination.

11. Receiving Calls: BIZ Agency Owners shall not answer the telephone BIZ or initially respond to the caller in any manner that gives the caller the impression that he/she has reached the Corporate Office of BIZ.

12. Prerecorded Telephone Solicitation Devices: The use of the company name or copyrighted materials may not be made with automatic calling devices or "boiler" room operations to solicit BIZ products, services and income opportunity.

13. Media Inquiries: BIZ Agency Owners of BIZ may not solicit coverage or publicity from the media regarding their BIZ business, nor may they appear on radio or television talk shows to promote their BIZ activities. If an BIZ Agency Owners is contacted by the media (radio, television or the press), the contact should be referred to the BIZ Corporate Office in order to ensure accuracy and a consistent company image.
